Family Law:

How much does it cost to file for divorce?

The cost to file for divorce is set by the Circuit Court in each county. As of October 1, 2009, it costs $405.00 to file a petition for divorce (also known as a petition for dissolution of marriage) in Multnomah County. For the current filing fee schedule for Multnomah County, click here.

The filing fee in Clackamas County is $381.00. For the current filing fee schedule for Clackamas County, click here.

If you cannot afford the filing fee, you can ask the Court to waive it. You must file a motion asking for the waiver when you file your divorce papers.

Do I need a lawyer to file for divorce?

No, you don't need to hire a lawyer for a divorce. You can find forms and information about filing papers yourself here , at the Oregon Judicial Department's website. BUT, you should be very, very careful if you are going to file for divorce without the help of a lawyer.

Most people going through a divorce are under a lot of stress -- it can be difficult to think clearly.

People sometimes agree to everything the other party wants "just to get it over with." A year or two down the road, these people often regret being too hasty.

Once a divorce is final, it is very difficult to change the distribution of property, child support, or child custody arrangements.

My child's father and I are not married – does he have a right to custody?

If paternity has been established, then you and your child's father have the same rights regarding custody and child support as a married couple.

If paternity has not been established, then only the mother has the right to custody, but she does not have any right to child support.
